Re: Exterior Modifications/ARB Approval
Dear Boynton Lakes III Owner:
This letter is being written on behalf of the Board of Directors. It has been noticed that there is a lot of work being done on homes that is not being approved by the Board of Directors. Recently. several homes have been seen putting on new roofs without submitting an ARB application for proper approval. As a reminder and per your Governing Documents:
Article VIII- Architectural Control:
No building, fence, wall or other structure shall be commenced, erected or maintained upon lots, common open spaces or private drives, nor shall any exterior addition or change of alterations therein including a change of the building, fence or all exterior paint color, be made nor shall any improvements be made within a lot, common open space or private drives until the plans and specifications showing the nature, kind shape, height, materials, color and location of the same shall have been submitted to and approval in writing as to the harmony of external design and location in relation to surrounding structures and topography by the Board of Directors of the Association,
or by an Architectural Control Committee composed of three (3) or more representatives appointed by the board.
In the event said Board, or its designated committee, fails to approve or disapprove such design and location within thirty (30) days after said plan and specifications have been submitted to it, approval will not be required, and this Article will be deemed to have been fully complied with.
Nothing contained herein shall relieve the owner from the responsibility of obtaining proper governmental approvals and permits.
If you plan to do any exterior work to your home, you must contact the management office and obtain the necessary ARB application to be completed and submitted with all corresponding documents outlining the project.
Exterior work to include re-roofs cannot commence without approval given by the Board of Directors and as mentioned above from the documents, "Nothing contained herein shall relieve the owner from the responsibility of obtaining proper governmental approval and permits".
What this means is, if you proceed with an exterior project, you could be required to remove any exterior work including roofs until approved. Unapproved exterior work can also come with legal action and expenses charged to you.
If you have received a notice of ARB Violation, you are to cease work and contact management.
