Although the board tries to be considerate of people's situations the community must realize the board has a duty to maintain and upkeep the common areas of the community just as owners have a duty to maintain the exterior of their property.. Article IX Maintenance and Exterior of Owners Property states as follows: I n the event an owner of any lot fail to maintain the exterior of his unit and other improvements situated on a lot in a manner satisfactory to the Board of Directors , the Association, after approval by two-thirds (2/3) vote of the Board of Directors, shall have the right, through its agents and employees, to enter upon said parcel and to repair, maintain, and restore the lot and the exterior of the buildings and any other improvements erected thereon. The cost of such exterior maintenance shall be assessed against the subject to, and such assessment shall be charged on the land and shall be a continuing lien upon the property. Non-payment of such assessment within thirty (30) days from the due date may result in foreclosure of the lien or an action at law against the owner(s) of the lot. The Board of Directors would like to remind the community that they can fine the Statutory $100 per day up to $1000 per occurrence on top of Article IX. With that being said if you receive a notice in the mail for areas around your home that need maintenance, please do not ignore the letter. If you need additional time, please contact Davenport with an extension request. This will ensure you are in communication with management about the violation and will avoid the board stepping in and making repairs, levying fines and potential legal fees. If you receive a violation and you complete the work, you can simply contact Davenport and advise the violation is completed or send an email to info@davenportpro.net. Garbage, Recycle, & Trash (bulk) pick-up rules are enforced by; Boynton Lakes HOA-3, and are governed by the City of Boynton Beach (fining) regulations. All garbage & recycle bins may not be placed at the curb before 6:00 p.m. the evening before pick-up day. Retrieval of garbage barrels and bins must be placed back behind the front fence, or in a spot behind something to hide them from street view, before 6:00 p.m. the day of pick-up. Monday A.M. pick-up: Green garbage bins, Blue & Yellow recycle bins. Thursday A.M. Green garbage bins (only), and Trash (bulk) Special pick-up's for large amounts of building materials may need a call to Public Works at 561-742-6200. Board of Director meetings are scheduled, as needed, on the second Monday of the month. We have alternate street parking. Even number months : (( Feb, Apr, Jun, Aug, Oct, Dec )) parking is allowed on the side of even number house numbers. Odd number months : (( Jan, Mar, May, Jul, Sept, Nov )) Odd number months, parking is allowed on the side of odd number house numbers. There are signs on all streets Indicating the parking regulations. SOME CLARIFICATION ON STREET PARKING. Include the list of Streets with the approved parking regulations. Winchmore Lane and Flint Way Monthly alternate parking at all times. Weedon Dr. and Rogart Circle Entire street is parking on unit side only at all times. Fawlkland Circle No parking restrictions EXCEPT , at both ends of the street NO PARKING, (end at the lake & end at the tennis court), per the City of Boynton Beach reserved for emergency vehicle use. Walcott Dr. Monthly alt. parking at all times, Except from unit 27 - 37, where parking is allowed on the unit side only. Mayfair Lane and Farnworth Dr. Watch street signs; Some signs say alternate side parking, Some signs say unit side parking, Some signs say NO Parking. No parking on the grass anywhere, anytime. All vehicles should be parked in the direction of the traffic flow, (except) by notice in certain circumstances authorized by B. O. D.

I am a Property Manager for your community. The purpose of this letter is to offer some friendly reminders of procedures that seem to have been forgotten. Lot sales and Leasing of Lots, both need to be registered with the Property Manager, and individuals will be interviewed. All new and existing Home owners/lessees must register their license plates. If your planning to plant flowers, trees, and doing projects around your home, (Plantings must stay within your property lines, not on common areas.) As a strong reminder to all residents, there are projects that must be approved by the Board of Directors prior to any work on the exterior of the home is started . ( Some of the items are to include but not limited to: ) Roof Replacement - (approved shingle colors) Painting of Home - (approved house & trim colors) Tree Removal Painting Driveway - (approved colors) Driveway/Pad Work; (widening, paint colors, etc.) Hurricane Shutters - (approved colors) Window Replacement - (bronze) Landscaping removal and new additions (arc form) To start the approval process of the above topics, an ACC application must be obtained from Davenport, by calling 561-642-5080 or email to info@davenportpro.net and request an ACC application. If you are uncertain if an ACC form is needed for a project that you may be considering, please contact Davenport for clarification. Driveway / Pads need to be approved with Benjamin Moore colors and can be stained, in either oil based, or water based depending on preference. (no tiles, or designs) The Board will also allow (unpainted) natural concrete in lieu of painting. The colors are Grey, and Tan and the Board will allow slightly one shade lighter or one shade darker. Color sample must be supplied when completing the ACC application for approval. ( adjoining driveways must be the same color ). As a reminder to all residents we have designated street parking, with signs posted. The rules are based on the time of year and which side to park on. Cars should park in your own driveways, to avoid clogging the street, and make it difficult for cars to pass, and not to cause problems for police, EMT and Fire Rescue. There is no parking on the grass at anytime , to avoid damaging irrigation pipes etc, or the grass. Please be courteous to your neighbors when having guests, to avoid blocking driveways, or making it difficult for someone to pull in or out. It is recommended that guests should park at the satellite pool while visiting. Visitors must be told by the owner or resident what the parking rules are here to avoid a violation. Complaints of loud music at all hours of the night have become disturbing to neighbors. Boynton Beach has a noise ordinance that should be followed at all Times: Sunday – Thursday 7am to 11pm Friday, Saturday & Holidays 11pm – 7am If you find that a neighbor is not adhering to the times above, you may call anonymously to the Boynton Beach Police Non-Emergency number (561-732- 8116) and file a complaint, and the Police will come out and address the noise Complaint. Please do not hesitate to call the Police that is what they are here for. I would like to remind everyone that if you have an issue within the community, or you need work done, call Davenport and we will create a work order and send it to the appropriate party. Residents should not stop Fred and ask him to do work, or fix irrigation, or anything that may pertain to the community, you should call Davenport and put in a work order. Some of you may have already received violation letters concerning your homes or lots, that need attention. Homes are being inspected regularly and violation letters are being sent to point out violation items around the home. T hese letters are not to be ignored and we are asking that you inspect your home and look for things like pressure cleaning your driveway, cleaning your roof, touch up paint, rotten wood or siding, landscaping, clogged gutters etc. I understand that 30 days may not be enough time to complete a violation and we ask that you contact Davenport, and ask for an extended period of time to complete your work, we will extend that courtesy, but the v iolation will need to be completed by the end of the requested extension. Simply contact Davenport and customer service representative will note your file with the extension request. For those who may not be aware the customer service representative for Boynton Lakes 3 is Alexa and you can reach out to her for extension requests or email info@davenportpro.net. I have given her the authority to allow for extensions and she will be glad to assist you. Fine’s will be imposed if violations are not corrected within a reasonable length of time. The Board and I would like to thank the residents of phase 3 in taking notice of the items addressed in this letter and appreciate full cooperation.
