Re: Maintenance and Exterior of Owners Property

Dear Owners of Boynton Lakes III


The Board of Directors along with management have been working and sending out letters to owners who have maintenance items around their homes that need attention. Although the board tries to be considerate of

people's situations the community must realize the board has a duty to maintain and upkeep the common areas 

 of the community just as owners have a duty to maintain the exterior of their property..


Article IX

Maintenance and Exterior of Owners Property states as follows:

In the event an owner of any lot fail to maintain the exterior of his unit and other improvements situated on a lot in a manner satisfactory to the Board of Directors, the Association, after approval by two-thirds (2/3) vote of the Board of Directors, shall have the right, through its agents and employees, to enter upon said parcel and to repair, maintain, and restore the lot and the exterior of the buildings and any other improvements erected thereon. The cost of such exterior maintenance shall be assessed against the subject to, and such assessment shall be charged on the land and shall be a continuing lien upon the property. Non-payment of such assessment within thirty (30) days from the due date may result in foreclosure of the lien or an action at law against the owner(s) of the lot. The Board of Directors would like to

remind the community that they can fine the Statutory $100 per day up to $1000 per occurrence on top of Article IX.

 

With that being said if you receive a notice in the mail for areas around your home that need maintenance, please do not ignore the letter. If you need additional time, please contact Davenport with an extension request. This will ensure you are in communication with management about the violation and will avoid the board stepping in and making repairs,

levying fines and potential legal fees.


If you receive a violation and you complete the work, you can simply contact Davenport and advise the violation is completed or send an email to info@davenportpro.net.
